General terms and conditions for using the Challanger software solution

1. General provisions and consent

These General Terms and Conditions for the Use of Challanger Software Solution (hereinafter referred to as "application") set out the obligations, rights and conditions of use of the Application and the instructions to its users to use the application.

The general terms and conditions may be updated and are accessible to anyone in the app at any time in their latest and valid version.

Entry, registration or application registration means that the user agrees to all restrictions and conditions set out herein and that, as a user of the application, he is previously clearly and comprehensively aware of the terms of use, as well as the protection of copyright and personal data protection policy. The general terms of use are also fully and in the same way applicable to users who access the app as unregistered or undeclared visitors.

By using the application, the user confirms that he has carefully read, agreed with, and fully accepting the general terms of use. As app users, all users or visitors who access the app as logged in or unregistered or undeclared visitors are meant.

Befine-Pro reserves the right to modify or update the App and its contents at any time, in any way, without reason or without giving reason, without prior notice. No responsibility is assumed for any consequences of such changes by Befine-Pro.  Due to technical or functional upgrades of the application, Befine-Pro reserves the right to publish a new version of the application. The user will be notified of the new version of the app or changes through the app itself, provided that it renews the upgrades of that app.

2. Use the app

2.1 Through the web interface

The user can use the application via the web browser in the general terms and conditions specified in the application. Access to the URL is sent to each competition organizer when they are registered to compete.

2.2. Download an app for use on mobile devices

The user can also download the app through the mobile store for mobile apps, in the manner and under the conditions set for selected online stores for mobile apps (Apple iOS: iTunes Store, Google Android: Play Store, website).

The use of the software is free of charge for registered players or teams, where registered players or teams are not required to pay for the data transfer (at home or abroad) charged by the selected operator at each applicable price list, if the software accesses through data; or pay for an Internet connection if it accesses the application through it.

2.2. Technical requirements

Connecting to a mobile network or (wireless) internet connection is required to download and use the application. Without a network or Internet connection, the application only works with limited functionality. But the tide works on iOS (Apple) or Android (Google) operating systems.

2.3. Registration and registration

You must pre-register for first access to the app. With a successful registration process, the user obtains the opportunity to enter their own profile. When registering, the user must select a username and password.

If a user forgets their password or wants to change it, they can reset or change their password at any time.

Full functionality and access to all application content requires registration or login.

Before registering with the application, the user must fully familiarize, accept and confirm his agreement to these general terms and conditions. By ticking the appropriate field in the context of the application registration, the user is deemed to have read and agree with the applicable terms of use of the application by ticking the appropriate field in the context of the application registration. The user must explicitly confirm at the time of registration that he agrees to the intended processing of his or her personal data.

2.4. Unauthorized use of username or password

The user must properly protect his or her password username and other identification information.

In the event of unauthorized use of the username or password, the user is obliged to immediately notify Befine-Pro on electronic [email protected]. The notification must provide details of the user's first and last name, e-mail address and unauthorized use details. Befine-Pro shall have the right, in the event of unauthorized use and/or any other misuse of the application by users or any other person and/or in the event of suspected misuse of the password, to take all measures and other actions necessary to protect its rights and interests and to protect the rights and interests of other users or persons.

The security and confidentiality of all data stored on a mobile or other device is solely the responsibility of the user.

3. About the application and competition rules

The app is designed to organize sports competitions, challenges, monitor results, connect users and post news about all of the above.

Competition rules that apply to all app users are published in the app. Befine-Pro may change or update the rules of competitions at any time, in any way and without reason or without giving reason, without prior notice. No responsibility is assumed for any consequences of such changes by Befine-Pro.

4. Protection of personal data and cookies

We process personal data in accordance with European law (Regulation (EU) 2016/697 on the protection of individuals, with regard to the processing of personal data and on the movement of such data (hereinafter referred to as "general regulation"), the applicable Slovenian legislation in the field of the protection of personal data and other legislation which gives us the legal basis for the processing of personal data.

The protection of personal data and cookies is governed by a privacy policy (Privacy Statement) available on the https://www.befine-pro.com/izvaja-o-varstvu-zasebnosti website and fully applicable, unless otherwise regulated by these General Terms and Conditions.

4(1). Unregistered users

Befine-Pro will store anonymized data on the application's use for the purpose of conducting user experience analyses in order to ensure appropriate customizations, upgrades and improvements to the application.

4(2). Registered users

User's consent to the collection and processing of personal data: By registering in the application and agreeing to the general terms and conditions, the user is deemed to consent to the user's consent to the inclusion of his personal data in the list of registered users of the application and to agree to the use of his personal data in the manner and for the purposes described in these Terms and Conditions and the Privacy Statement.

Agreeing to these general terms and conditions is a condition for successful user registration in the app.

Upon registration or registration, the user provides the following personal data: first and last name, date of birth, e-mail address, telephone number. The user can also upload a photo to the app that is posted and visible in the app to all users. The user may also provide other personal data as specified in the Privacy Statement necessary for the use and purposes of the Application and if the user agrees.

The user agrees that Befine-Pro collects, processes, stores and uses personal data for the purposes of organization of competitions, challenges, track results, connect users and publish news about all of the above, and advertise the app's users.

The user agrees that Befine-Pro forwards the user's first and last name, telephone number and e-mail address to another user by e-mail for the purposes of competitions, challenges and other functionality of the application. The disclosure of the user's personal data to another user is necessary to enable the organization of the competition, challenge or similar, all in accordance with the rules of competition.

The user agrees that if they upload a photo to the app when they register (or later) on the app, this photo is visible to all users of the app. The user may withdraw its consent to publish the photo at any time.

The user agrees that photos and videos from competitions, challenges, meetings, etc., organized through the app, can be posted in the app for all defined purposes in these general terms and conditions. If the user no longer agrees with the above, he must inform Befine-Pro in writing.

4.2.1. Protection of personal data

Befine-Pro, as the controller of personal data, undertakes to protect personal data provided by the user and use them only for the intended purposes.

4.2.2. User anonymity

The user may choose to make the name of the app anonymity when registering, which means that other users of the app do not see their first and last name, date of birth and other information that the user communicates at the time of registration. In case the user chooses to anonymize the profile, they must choose the username that other users of the app will see to use the application.

Even if the user chooses the anonymized profile option, the user agrees that his name and surname, telephone number and e-mail address are forwarded by e-mail to another user for the purposes of competitions, challenges and other functionality of the application. The disclosure of the user's personal data to another user is necessary to enable the organization of the competition, challenge or the like. That personal data shall be disclosed only to the user to whom such disclosure is necessary.

5. Stop providing or using the application

Befine-Pro may stop providing the app at any time by notifying users in an appropriate manner.

The user has the right to stop using the app at any time by deactivating the user account itself and/or the app erases the is of their mobile phone or tablet.

6. Violation of the general terms and conditions

Befine-Pro reserves the right to prevent users who violate or act against the General Terms or From Violating the App and otherwise prevents the delivery of any email or other communication with the Application, or to prevent users from violating other people's rights.

If there are any disputes with the application, Befine-Pro and the user will resolve any disputes by mutual agreement and, in the event of failure, before the local and in-kind competent courts under the law of the Republic of Slovenia.
